The Nelk Boys, the YouTubers Kyle Forgeard and John Shahidi’s defense attorneys, have moved to reject a class-action petition that alleges they were afoul of their Full Send Metacard NFT job.

The claimant turned down a full refund, according to the Nelk Boys ‘ counsel, and the problem lacks certain false allegations.

The defendants were accused of defrauding customers with claims of special benefits and community exposure in the lawsuit that was filed in January on behalf of Metacard NFT buyers.

Prior to the sale on January 19, 2022, which caused the plaintiff to buy a sign on that date, the pair allegedly made up the Metacard program.

The plaintiff claimed that the accused continued to make false claims after the NFTs were sold, preventing the complainant and other possible class individuals from realizing they had been misled.

According to the problem,” the accused ‘ false and misleading statements were widely distributed through press releases, social media posts, YouTube video, podcasts, and other promotional materials related to Full Send and Metacards.”

The Nelk Boys ‘ security claimed in a motion filed on April 17 in the U.S. District Court for the Central District of California that the problem is moot due to the payment present and doesn’t meet basic scams requirements.

The lawyers wrote that defendants mooted these claims by offering a full refund plus interest to every Metacard holder, including the plaintiff, after the broader NFT business collapsed. Plaintiff may repent his purchase, and he may decline a full refund. However, dread does not constitute scams. The problem ought to be dropped.

The Nelk Boys, a group of Canadian-American performers known for their game films and party-themed brands like Full Send, products, and alcoholic drinks, were founded by Forgeard and Jesse Sebastiani in 2010. The Nelk Boys have 674, 000 supporters on X and 8 million subscribers on YouTube.

In January 2022, The Nelk Boys launched the Metacard NFT job. The selection of 10, 000 Ethereum NFTs, which were collectively sold for about 0.8 ETH, about$ 2,300 at the time, was completed, and raised about$ 23 million.

According to CoinGecko data, the collection is down 91 % to the floor price of$ 111 as of the time of writing.

The security claimed that the problem failed to locate any particular pre-sale misrepresentations, fake statements, or proof that the claimant relied on to purchase the Metacard NFT, and that the alleged promises generally corresponded to the benefits the plaintiff acknowledged receiving.

” Plaintiff’s says rise and fall based on what was said before he purchased his Metacard. However, there is no pre-sale speech in the problem. That is inconclusive, according to the defence. ” Everything else is officially irrelevant, from post-sale responses to assumptions and regret,” the statement read.

Defendants and accused ‘ prosecutors did not respond to Decrypt’s request for comment.
